Serving Divorce Petitions: A Guide for Legal Professionals

A divorce petition — now formally a divorce application under the no-fault divorce framework introduced by the Divorce, Dissolution and Separation Act 2020 — is the document that commences proceedings to legally end a marriage. Correct personal service is essential: without it, the court cannot be satisfied that the respondent is aware of the proceedings, and the case may be delayed or struck out.
