A Specific Issue Order (SIO) is a court order made under Section 8 of the Children Act 1989 that resolves a particular dispute about a child's upbringing when parents cannot agree. Unlike a Child Arrangement Order (which deals with living and contact arrangements), a Specific Issue Order addresses a single, defined question.
These orders are used when parents with parental responsibility disagree on a significant decision affecting their child's welfare. The court makes the decision in the child's best interests, applying the welfare checklist set out in Section 1(3) of the Children Act 1989.
The application and any subsequent court order must be served on the respondent parent (and any other parties to the proceedings). Personal service ensures that the respondent is aware of the application and can attend court to present their position.
